Introduction to boulevard by-laws:

The Boulevard Maintenance By-Law 125/2007 was passed May 16, 2007 as a regulatory by-law for the department of public works. The by-law states that:

A By-law of the City of Winnipeg to require maintenance and encourage beautification of boulevards. (City of Winnipeg 2007).

This was amended on June 20, 2007 to be effective immediately, to include:
Prior to making any excavation in a boulevard, the owner or occupant of property must contact utilities and other owners of underground structures to ensure that no underground structures will be disturbed or damaged by the proposed excavation. (City of Winnipeg 2007).

By-law sections to note (City of Winnipeg 2007):
5(3). Where a non-standard boulevard treatment results in the undermining or failure of the adjacent roadway, the owner of the property adjacent to the boulevard to which a non-standard treatment has been applied must pay a fee equal to the reasonable costs of replacing the non-standard boulevard treatment with turf.
6(3). The Director may impose reasonable conditions on a permit issued under this section, including requiring that the property owner agree to provide an indemnity or a damage deposit to the City.
11. Designated employees may conduct inspections and take steps to administer and enforce this By-law or remedy a contravention of this By-law in accordance with The City of Winnipeg Charter and, for those purposes, have the powers of a “designated employee” under The City of Winnipeg Charter.
